• General Conditions of Sale
Preamble
The site is the property of STALLBOIS in its entirety, as well as all the rights relating thereto. Any total or partial reproduction shall be automatically subject to authorisation from the owners. Nevertheless, hypertext links to the site are authorised without specific application. Wintower is a registered trademark belonging to STALLBOIS.
- After-sales service is provided by the manufacturer after the client has reported the problem in detail, with supporting photographs.
- Any dispute between the vendor and the purchaser is within the jurisdiction of the Courts in ARLON, Belgium.
- Wintower undertakes not to divulge or to use client data for purposes other than its own information or promotional activities.
1. Acceptance of the Conditions
The client acknowledges awareness, at the time of placing the order, of the Specific Conditions of Sale indicated on this screen and expressly accepts them without reservation.
The present General Conditions of Sale govern the contractual relations between STALLBOIS and its client, the two parties accepting them without reservation. These General Conditions of Sale shall prevail over all other conditions appearing in any other document, unless there is prior express written derogation.
2. Products
Photographs illustrating products are not contractual. STALLBOIS may not be held liable for any errors. The majority of products offered to its clients by STALLBOIS are available in our store.
- Assembly of shelves is very simple and requires no particular tools. Nevertheless, in order to ensure the stability of the furniture, the metal rods delivered with the product must be fixed to the rear using the holes drilled as shown on the assembly diagram. The materials used have been chosen to ensure good stability at a constant level of humidity up to 65% in the storage space. The furniture must never be in contact with a damp wall and must be insulated from damp soil by a layer of plastic or other material providing a total barrier against rising damp (Diba or visqueen type construction plastics may be used).
- The shelves or racks of the Wintower system are designed to support 4 layers of 75 cl bottles at a maximum and for layers of 6 bottles may present a deformation by up to 3 mm under the storage conditions recommended above without there being any danger whatsoever of sagging.
3. Order
Automatic recording systems are considered valid proof of the nature, content and date of the order. STALLBOIS confirms acceptance of the client’s order to the mail address given to it by the latter. The sale shall only be concluded on confirmation of the order. STALLBOIS reserves the right to cancel any order from a client with which there might be a dispute in relation to payment for an earlier order. The information given by the purchaser when the order is taken is binding upon them: in the event of an error in the recipient’s details, the vendor may not be held liable for its inability to deliver the product.
4. Delivery
After confirmation and payment of the order, STALLBOIS undertakes to deliver to its transporter all the references ordered by the purchaser. That transporter undertakes by contract with STALLBOIS to deliver the order to the address provided by the purchaser. In the case of transport cash on delivery, the client undertakes to pay the transporter or its representative the entire sum indicated on the order confirmation.
In addition, for deliveries outside Belgium the client undertakes to pay all taxes due on the importation of products, customs duties, VAT and any other taxes due by virtue of the Laws of the country in which the order is received. All orders placed with STALLBOIS are intended for the personal use of clients, and clients or recipients of products are forbidden to resell all or any of the products. STALLBOIS waives any legal liability if the client has not settled any taxes.
Delivery is made within the timeframe agreed with the client by the direct delivery of the product to the declared recipient, or if they are absent to any other person authorised by the client. Possible delays shall not give rise to a right on the part of the purchaser to claim damages or interest.
In the event of patent defects, the purchaser is entitled to return them under the conditions provided in this document.
Considered to be cases of force majeure releasing the vendor from liability to deliver are war, insurrection, fire, strikes, accidents and the impossibility of receiving supplies. Goods always travel at the risks and perils of the addressee. Always check your carton on arrival. You have a time limit of 48 hours in which to notify the transporter of any reservations if there is anything missing or damaged.
For reasons of availability, an order may be delivered to the client in more than one instalment. Then the client shall only pay for a single delivery. If the client wants the delivery to be made in two places, then they must place two orders, with the associated delivery costs.
5. Withdrawal
You have 14 days (to count from receipt of the goods) in which to give your opinion. In the event of exchange or reimbursement, send the new goods with their original packaging intact, accompanied by any possible accessories, notices of use and documentation to the following address:

6. Price
The price is expressed in euros.
The price indicated on product sheets does not include transport.
The price indicated in the order confirmation is the definitive price, expressed to include all taxes and including VAT for Belgium and EU countries. This price includes the price of the products, handling charges, packaging and storage of products, transport and commissioning costs.
7. Payment
The price invoiced to the client is the price indicated on the order confirmation sent by STALLBOIS.
The price of products is payable cash on the effective date of order.
Payment made by bank card with the CB, Visa or Mastercard logo.
Online, CIC PAYMENT enables you to pay via a CIC bank server in a secure environment.
Your bank card number is thus sent to the bank’s servers, your payment is made directly to a bank in a secure environment without passing through a shop server, an even greater guarantee that your numbers are known only by our CIC banking partner.
The order validated by the client shall only be considered effective when the bank payment centres concerned have given their agreement. In the case of refusal by the said centres, the order shall automatically be cancelled and the client informed by electronic mail. Furthermore, STALLBOIS reserves the right to refuse any order from a client with whom there is a current dispute.
8. Disputes
The present contract is governed by Belgian Law. STALLBOIS may not be held liable for material, immaterial or bodily damage of any kind which might result from poor operation or poor use of the products marketed. The same shall apply to any manufacturer’s modifications of the products. In any event the liability of STALLBOIS shall be limited to the amount of the order and cannot be asserted for simple errors or omissions which might arise despite all the precautions taken in the presentation of products. In case of difficulties in the application of the present contract, the purchaser has the opportunity, before any legal action, to seek an amicable solution with the aid in particular:
of a professional association in the sector, a consumer association or any other adviser of their choice. It is recalled that seeking an amicable solution amiable does not interrupt the "short period" of the legal guarantee or the term of the contractual guarantee. It is also recalled that as a general rule and subject to the assessment of the Courts observance of the provisions of the present contract relating to the contractual guarantee assumes that the purchaser honours their financial obligations to the vendor.
Claims or objections shall always be received with careful consideration, good faith always being presumed of those making the assertions. In the case of dispute, the client shall contact the company as a matter of priority to find an amicable solution.
If not, the Commercial Court of ARLON, Belgium is solely competent, whatever the place of delivery or means of payment accepted.
9. Guarantee
In all cases STALLBOIS may not be held liable for non-observance of the regulatory and legislative provisions in force in the country of receipt, and the liability of STALLBOIS is automatically limited to the value of the product in question, its value at its date of sale and this without any opportunity to claim against the brand or company producing the product.
In any event, the client has the benefit of the legal guarantee against eviction and latent defects. Provided the purchaser proves the latent defect, the vendor is legally obliged to remedy any consequences; if the purchaser goes to the Courts then that must be within a "short period" to count from discovery of the defect.
